ARThood LLC (“ARThood” or “we” or “us”) respects and is committed to protecting your privacy, which is why ARThood adopted this Privacy Policy, which was last updated on May 17, 2011 and may require further updating. Through the website at www.arthood.com (the "Site"), ARThood provides you with access to varied user-generated and other content and interactive and informational resources (collectively, "Services").

This Privacy Policy sets forth ARThood’s policies with respect to information including personally identifiable data ("Personal Data") and other information that is collected from you when using the Site. For persons in the European Union, as used herein, terms such as "Personal Data" refer to "personal data" as defined by the Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data. ARThood will not collect any Personal Data from you unless you provide it to ARThood voluntarily with your freely given specific and informed consent. By using the Site, you agree that ARThood may transfer your Personal Data outside the European Union in connection with the purposes stated in this Privacy Policy. Your Personal Data may be transferred to the United States (and/or other non-European Union jurisdictions, as applicable).

You agree that your Personal Data may be processed by ARThood in the country where it was collected as well as other countries (including the United States) where laws regarding processing of Personal Data may be less stringent than the laws in your country.

Information ARThood Collects

When you interact with ARThood through the Site, ARThood may collect Personal Data and other information from you, as further described below:

Personal Data That You Provide Through the Site: ARThood collects Personal Data from you when you voluntarily choose to provide such information, such as when you contact ARThood with inquiries, respond to our surveys, register for access to the Services or use certain Services. Wherever ARThood collects Personal Data ARThood makes an effort to provide a link to this Privacy Policy. By voluntarily providing ARThood with Personal Data, you are consenting to our use of it in accordance with this Privacy Policy. If you provide Personal Data through the Site, you acknowledge and agree that such Personal Data may be transferred from your current location to offices and servers of ARThood, its affiliates and its contractors located in the United States and in other countries.

Other Information:

Non-Identifiable Data: When you use the Site, ARThood may receive certain personally non-identifiable information about your use of the Site. Such information, which is collected passively using various technologies, cannot presently be used to specifically identify you. ARThood may store such information ourselves or it may be included in databases owned and maintained by our affiliates, agents or service providers. ARThood may use such information and pool it with other information to track, for example, the total number of visitors to the Site, the number of visitors to each page of the Site, and the domain names of our visitors' Internet service providers. It is important to note that no Personal Data is available or used in this process.

In operating the Site, ARThood may use cookies. A cookie is a piece of information that the servers that host the Site give to your browser when you access the Site. Our cookies help provide additional functionality to the Site and help ARThood analyze the Site usage accurately. For instance, the Site may set a cookie on your browser that keeps you from needing to remember and then enter a password more than once during a visit to the site. (Please refer to the “Help” section on your browser’s toolbar for information on how to receive notice when you are receiving a new cookie and how to turn cookies off.) ARThood recommends that you leave cookies turned on because cookies allow you to take advantage of some of the Site’s features. You have the ability to choose whether to accept cookies by changing the settings of your browser; however, if you choose not to accept cookies, your experience on the Site may be diminished and some features may not work as intended.

Aggregated Personal Data: In an ongoing effort to better understand and serve the users of the Services, ARThood may conduct research on our end users’ demographics, interests and behavior based on the Personal Data and other information provided to ARThood. This research may be compiled and analyzed on an aggregate basis, and ARThood may share this aggregated data with our affiliates, equityholders, agents and business partners. This aggregate information does not identify you personally. ARThood may also disclose aggregated user statistics in order to describe our services to current and prospective business partners and to other third parties for other lawful purposes.

ARThood’s Use of Your Personal Data and Other Information

ARThood will use the Personal Data you provide in a manner that is consistent with this Privacy Policy. If you provide Personal Data for a certain reason, ARThood may use the Personal Data in connection with the reason for which it was provided. For instance, if you contact ARThood by e-mail, ARThood will use the Personal Data you provide to answer your question or resolve your problem. Also, if you provide Personal Data to obtain access to the Services, ARThood will use your Personal Data to provide access to such Services and to monitor your use of such Services. ARThood may also use your Personal Data and other personally non-identifiable information collected through the Site to help ARThood improve the content and functionality of the Site, to better understand our users and to improve the Services. ARThood may use this information to contact you in the future to tell you about services ARThood believes will be of interest to you.

ARThood will communicate with you through email and notices posted via the Services. These communications may include a series of welcome emails, which help inform you about various features of the Services. Please be aware that you will also receive emails from ARThood related to the proper functioning of your account. ARThood may additionally send you promotional information. If you wish to opt-out of promotional emails, please clearly opt-out during the registration process.

Our Disclosure of Your Personal Data and Other Information

There are certain circumstances in which ARThood may need to share your Personal Data with third parties without further notice to you, including as set forth below:

Business Transfers: As ARThood develops our business, ARThood might sell or buy businesses or assets. In the event of a sale, merger, reorganization, dissolution or similar event relating to all or a portion of our business, assets or the Site, Personal Data may be part of the transferred assets.

Service Providers, Agents and Related Third Parties: ARThood sometimes hires other companies to perform certain business-related functions. Examples include mailing information, maintaining databases and processing payments. When ARThood employs another company to perform a function of this nature, ARThood may need to provide them with access to certain Personal Data. However, ARThood only provides them with the information that they need to perform their specific function.

Legal Requirements: ARThood may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to: (i) comply with a legal obligation, (ii) protect and defend our rights or property, (iii) act in urgent circumstances to protect the personal safety of users of the Site or the public, or (iv) protect against legal liability.

Your Choices

When you register as a member of ARThood, ARThood asks you to provide Personal Data in the registration process. If ARThood wants to use this Personal Data in a manner different from the purpose for which it was collected, ARThood will ask for your consent prior to doing so. If ARThood proposes to use Personal Data for any purposes other than those described in this Privacy Policy and/or in the specific notice of Services, ARThood will offer you an effective way to opt-out of our use of your Personal Data for those other purposes.

Changing Profile and Account Information

Once you become a registered member of ARThood, you will have the opportunity to review, update or delete the registration information you have provided to ARThood at any time (except, of course, any information ARThood does not store). You may do so by selecting the “Edit Profile” link from the “Profile” tab, after clicking “Edit Profile” and following the instructions there.

You should be aware that it is not technologically possible to remove each and every record of the information you have provided to ARThood from our system. The need to back-up our systems to protect information from inadvertent loss means that a copy of your Personal Data may exist in a non-erasable form that will be difficult or impossible for ARThood to locate. ARThood covenants that promptly after receiving your request, all Personal Data stored in databases ARThood actively uses and other readily searchable media will be updated, corrected, changed or deleted, as appropriate, as soon as commercially reasonably practicable.

California Civil Code Section 1798.83 permits users who are California residents to request certain information regarding our disclosure of Personal Data to third parties for their direct marketing purposes. Exclusions

This Privacy Policy shall not apply to any unsolicited information you provide to ARThood through the Site or through any other means. This includes, but is not limited to, information posted to any public areas of the Site, such as open forums (collectively, "Public Areas"), any ideas for new products or modifications to existing services, and other unsolicited submissions (collectively, "Unsolicited Information"), including all Content (as that term is defined in the Terms of Service Agreement). All such Unsolicited Information shall be deemed to be non-confidential, and ARThood shall be free to reproduce, disclose, distribute, and otherwise use such Unsolicited Information without limitation or attribution. Please also note that any Personal Data or other information you provide to be displayed in your publicly available online profile will be displayed for others to see and thus will not be subject to the terms of this Privacy Policy. ARThood cannot and will not be responsible for what third parties do with any Personal Data or other information that you choose to make publicly available. As such, ARThood advises that you exercise great care in determining what information you choose to make publicly available through the Site.

Children

ARThood does not knowingly collect Personal Data from users under the age of 18 and does not target the Site to users under the age of 18. If you are under the age 18, you are prohibited from using the Site, including without limitation, submitting any Personal Data through the Site. ARThood encourages parents and legal guardians to monitor their children's Internet usage and to help enforce ARThood’s Terms of Service Agreement, which includes this Privacy Policy, by instructing their children to never use the Site nor provide Personal Data through the Site. If you have reason to believe that a child under the age of 18 has provided Personal Data to ARThood through the Site, please contact admin@arthood.com, and ARThood will use commercially reasonable efforts to delete that information from its databases.

Links to Other Websites

This Privacy Policy applies only to the Site. ARThood may contain references or links to other websites not operated or controlled by ARThood (the "Third Party Sites"). ARThood is not responsible for the privacy practices or the content of Third Party Sites, and the policies and procedures described here do not apply to Third Party Sites. The links from the Site do not imply our review or endorsement of any linked Third Party Sites, and you should carefully review those sites for information on their privacy policies. Advertisers and third parties that provide products or services through a third party website may also assign their own cookies to your hard drive, a process ARThood does not control. ARThood also may use third-party advertising companies to serve ads when you visit the Site. These companies may use information (not including your name, address, email address or telephone number) about your visits to the Site and other web sites to provide advertisements on the Site and other sites about goods and services that may be of interest to you.

Security

ARThood takes commercially reasonable steps to protect the Personal Data provided through the Site from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. These steps include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where ARThood stores Personal Data. However, no Internet or e-mail transmission is ever fully secure or error-free. In particular, e-mail sent to or from the Site may not be secure. Therefore, you should take special care in deciding what information you send through the Site’s e-mail. Please keep this in mind when disclosing any Personal Data to the Site through the Internet.

ARThood restricts access to Personal Data to our employees, contractors and agents who need to know that information to operate, develop or improve our Services. These individuals are bound by confidentiality obligations and may be subject to discipline if they fail to meet those obligations.

Data Integrity

ARThood processes Personal Data only for the purposes for which they were collected and in accordance with this Privacy Policy or any applicable Service-specific privacy notice. ARThood reviews our data collection, storage and processing practices to ensure that ARThood only collects, stores and processes the Personal Data needed to provide or improve our Services. ARThood takes reasonable steps to ensure that the Personal Data ARThood process is accurate, complete, and current, but ARThood depends on our users to update or correct their Personal Data whenever necessary.

ARThood regularly reviews its compliance with this Privacy Policy. Changes to ARThood’s Privacy Policy

The Site may change from time to time. As a result, at times it may be necessary for ARThood to make changes to this Privacy Policy. Accordingly, ARThood reserves the right to update or modify this Privacy Policy at any time and from time to time without prior notice. Please review this Privacy Policy periodically, and especially before you provide any Personal Data. This Privacy Policy was last updated on the date indicated above. Your continued use of the Site after any changes or revisions to this Privacy Policy shall indicate your agreement with the terms of such revised Privacy Policy.
